DESCRIPTION

This is a call to Ron Hoenig Minister of Local Government, Wendy Tuckerman shadow Minister Local Government, Paul Kelly Ombudsman NSW, Margerett Crawford Auditor General and ICAC; to call for a public enquiry into events surrounding the approval of the Sports and Recreation facility and awarding of $81M construction and $32M lease of public land at 266 Longueville rd.

the key concerns are:

Integrity of Lane Cove Council Long Term Financial Plan dated Ausgust 2022, which was used to gain approval.
The use of all developer contributions from new high density living complexes towards the sports centre instead of other needed facilities for these new families.
Awarding an $81M construction and ongoing operations of a Seniors Development to Longueville The Village Pty Ltd (March – May 2022) without tender process.
The removal of height constraints imposed by the Sydney North Planning Panel in March 2020 on the above development at 266 Longueville rd.
Shutting down the Commissioner Eric Armstrong public hearing process ( Rpt dated 10 March 2014) on rezoning 266 Longueville Rd from community land to operational land (Ref: Minutes of council meeting dated 17 March 2014).

I write to raise my concerns regarding the handling of the Sports and Recreation centre. It would seem that throughout the process, from leasing of 266 Longueville Rd as a source of funding; to the current situation, where all tenders exceed budget; there seems to have been serious breaches of due process and maladministration which has led to the loss of public trust.

I am concerned that the issues are systemic within Lane Cove Council (LCC), and will lead to considerable impact to the ongoing operations of the council and the residents of Lane Cove. I therefore call for a public enquiry into these questionable events; and that no further progress occurs on the Sports and Recreation centre until the outcomes are known.

I believe the key areas to be included are:

1.	Integrity of Lane Cove Council Long Term Financial Plan dated August 2022, which was used as part of the approval process for the $75M Sports and recreation centre, to assess life cycle financial impact to the council.

2.	The use of all developer contributions from new high density living complexes towards the sports centre instead of other needed facilities for these new families.

3.	Awarding an $81M construction and ongoing operations of a Seniors Development to Longueville The Village Pty Ltd (March – May 2022) without tender process.

4.	Drawing of T-Corp loan specifically for Sports and recreation centre in Dec 2022, prior to the proposal being approved in March 2023.

5.	Non-disclosure of impending Building Work Rectification Order by the Department of Fair Trading for the Pottery Lane units as reported on the In The Cove website (https://inthecove.com.au/2023/07/31/dept-of-fair-trading-issues-lane-cove-council-a-rectification-work-order-for-pottery-lane-building/ ). This is despite critical financial decisions being made regarding the Sports and Recreation Centre and an adjustment due to $480k unplanned impact to the budget causing an operating deficit of $402 (ref: page 32 of Council Minutes 22 June 2023).

6.	The removal of height constraints imposed in May 2020 by the Sydney North Planning Panel for the above development at 266 Longueville rd.

7.	Shutting down the Commissioner Eric Armstrong public hearing process ( Rpt dated 10 March 2014) on rezoning 266 Longueville Rd from community land to operational land (Ref: Minutes of council meeting dated 17 March 2014).
